REGULATIONS AND DUTIES THAT ARE REQUIRED TO BE PERFORMED
After acquiring any relevant permissions or sanctions, as needed by Indian law, the Manufacturer shall identify and appoint a person to serve as its authorized representative in India. The appointment of this person shall be officially informed to BIS in writing. The head of the Indian office, a senior official, or a statutory representative of the manufacturer in India are all examples of approved representatives.
The manufacturerâs designation must be written in the appropriate format and connected to letterhead. As a sign of your agreement with and acknowledgment of the terms of this Agreement, and to demonstrate your willingness to abide by various provisions of the Agreement/BIS Act 2016 and the Rules and Regulations there, the form designating the manufacturerâs authorized representative shall also include the signature of the authorized representative so designated, either at the time of entering into this contract or at the time of re-appointment during the term of this contract.
The Designated Authorized Representative of INDIA will continue to exist until another authorized representative is appointed in its place under the terms of the Agreement. For this Agreement, the Designated Authorized Representative of INDIA shall be deemed to be a person having ultimate control over the affairs of the Manufacturer and as such is also accountable for the proper performance of the terms of this Agreement and the BIS Act 2016 and the rules set forth therein.
